Czech Republic's Populist Prime Minister-Elect Refuses to Sell Business Empire During Ethical Dispute

Andrej Babiš, the self-proclaimed tycoon who secured victory in the recent Czech election, has refused to offload his vast corporate assets, while insisting he will address a ethical dilemma that might block him from taking the position of head of government.

Position on Corporate Empire

Babiš, whose ANO party came first in the October election but did not secure a parliamentary majority, stated in a social media post that he will not divest his Agrofert group, which operates in farming, food processing, and chemical industries.

“I have repeatedly stated I will not sell Agrofert. I have repeatedly stated I will address the ethical issue in compliance with national and European laws,” the billionaire remarked. “This is different from selling a pastry in a bakeshop.”

President's Demand

The head of state, Petr Pavel, stated that the 71-year-old political figure must publicly explain how he will remove ethical conflicts arising from his business activities before assuming the role of prime minister.

The Czech constitution “clearly mandates the head of state to consider the potential occurrence of a conflict of interest and the ways to address it” when appointing cabinet members, Pavel's office noted.

The head of state “expects clarity in what specific way Andrej Babiš will fulfil his statutory duties”, the announcement added, stating that Pavel was prepared to designate Babiš as premier “immediately” once the matter was settled.

Business Operations and Legal Issues

Babiš's numerous firms, mostly under the Agrofert umbrella, function in the Czech Republic and other central European countries, benefiting from substantial funds in domestic and European agricultural and other grants, as well as government deals.

Under Czech law, government ministers are barred from receiving public aid or contracts. The ethics organization Transparency International has indicated that to avoid a ethical breach, Babiš must either sell, decline public contracts, or stay out of government.

Past Tenure and Present Intentions

Babiš affirmed he would “abide by the laws” if appointed as prime minister, but did not want to explain how in advance because the matter was “an extremely sensitive and private affair for me, and the media will invariably question me regardless”.

During his initial tenure as premier, from 2017 to 2021, Babiš encountered multiple legal battles and an European inquiry over potential conflicts of interest. He placed his holdings into fiduciary arrangements, while keeping some influence over them.

A judicial body and the European Commission both determined that this was insufficient. Babiš confirmed last month that he was once more the exclusive proprietor of Agrofert and maintained he was “taking steps” to prevent a conflict of interest, but refused to reveal details.

Governing Agreement and Foreign Policy Implications

The wealthy politician has signed a coalition agreement with two minor right-leaning groups, the far-right, pro-Russian SPD, which has advocated a public vote on exiting the EU, and the Motorists for Themselves, which has mainly campaigned against the EU’s Green Deal.

The incoming administration, if approved, is expected to bolster the populist movement in the region and could strain western support for Ukraine – although Babiš has contacted Ukraine’s president, Volodymyr Zelenskyy, to assure him of Czech support.

Pavel, who as head of state has a role for international relations, also demanded that the coalition’s programme include a statement on the government’s position on Russia’s war in Ukraine, including a pledge to fulfilling alliance duties.

The president has earlier stated he would not endorse any cabinet candidates who might doubt the nation's international alliances, a requirement that the ultra-conservative party has said it will meet by nominating independent technocrats.
